1. This retainer is only refundable if the held date is able to be re-booked for another event with a package price the same or higher and no work has been performed; otherwise, the retainer is non-refundable. Due to Covid-19 the retainer is transferable to another date, subject to availability.
2. 50% of the remaining balance is due 180 days prior to the event date and the balance is due 30 days prior to the event. Credit cards may be used for the retainer ONLY. All other payments MUST BE MADE VIA CHECK/ZELLE or Venmo. Please be advised that we will not process the images from your event until the balance is paid in full.
3. Proofs will be delivered in approximately eight weeks from the event date.
4.In the event that Joe Mikos Photography LLC is unable to perform to the guidelines of this contract due to a fire, earthquake, calamity, emergency, strike, labor dispute, action of any public authority, act of God, act of terrorism, or any other occurrence beyond the control of the parties, or due to the photographers illness and if Joe Mikos Photography LLC is unable to provide a photographer that is agreeable to the client then all fees paid by the client will be returned in full, but Joe Mikos Photography shall have no further liability with respect to the agreement. If in the event that Joe Mikos Photography is unable to perform to the guidelines of this contract for any other reason Joe Mikos Photography LLC liability is limited to the fees paid by client for their services. This limitation of liability will also apply in the event of any dispute or in the event that the digital files are lost through camera malfunction, damage in processing, lost in the mail, or otherwise damaged or lost without fault to the photographer.
5. All copyrights to images created by Joe Mikos Photography LLC will remain with the photographer. Joe Mikos Photography LLC reserves the right to display any photographs made in conjunction with this event as samples of its work for the purposes of window and showroom exhibits, advertising, publication, instruction and professional competition. In the event a third party wishes to license use of any wedding images, Joe Mikos Photography LLC and client agree to negotiate in good faith and client reserves the right to refuse any commercial use.
6. Due to the fact that a wedding is an uncontrolled event, Joe Mikos Photography LLC cannot guarantee delivery of any specifically requested images. Joe Mikos Photography LLC is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the couple or other principles. Joe Mikos Photography LLC is not responsible for the lack of coverage due to weather conditions or scheduling complications due to lateness of individuals, rules and restrictions of venue or the rendering of decorations of the location.
7. Images are edited at photographer’s discretion, and delivered proofs may not include all images shot. The photographer reserves the creative right to edit and release only those deemed creditable as professional in quality and within the photographer’s artistic standards.
8. You may upgrade your package at any time but downgrading is not allowed for any reason once the contract is signed. Prices for products and services are valid from 6 months from the date of the event and there are no refunds for unused products or services.
9. Client agrees that Photographer shall be the exclusive photographer for the contracted events, and that no other person, business or company will be permitted to take photos or video stills without written permission from the Photographer. Family and friends of the Client shall be permitted to take occasional snapshots as long as they shall not interfere with the photographer’s duties.
10. This agreement constitutes the entire agreement between Joe Mikos Photography LLC and the client (Persons #1 & #2), and there are no other agreements, representations or warranties, whether written or oral, not included herein. This agreement may not be modified or amended unless in writing signed by you and the photographer. In the event any provision of this agreement is invalid or unenforceable, such invalidity or unenforceability shall not affect the remaining provision of the agreement. This agreement shall be governed by the laws of the Commonwealth of Massachusetts. In the event of a dispute client agrees to pay photographer’s attorney’s fees.
